Acceptance of Terms

Welcome to bereapca.org! This site is the online expression of the activities at “Berea Presbyterian Church” in Hockessin, Delaware (hereafter referred to as “BEREA”). It is a service of BEREA to the public and its members (hereafter the “public” and “its members” both referred to as “YOU”) for noncommercial use. Berea provides its service to YOU subject to the following “Terms of Use” (TOU), which may be updated from time to time without directly notifying YOU. Use of bereapca.org by YOU indicates acceptance of the TOU and represents a legal agreement between YOU and BEREA.

Scope of Service

The services provided on bereapca.org consist of access to a variety of content related to the activities at Berea, including, but not limited to, announcements, events, online audio sermons and teachings, and links to other web sites of potential interest to the user. Some content may be made available to members and friends of BEREA only on a restricted or controlled basis as a means of guarding sensitive family church information such as (but not limited) news, events, individual contact information, financial budgets, etc…. YOU are responsible for obtaining at your own expense access to the services (including but not limited to items such as a computer, appropriate software, an internet service provider, and a communication connection).

Disclaimer of Warranty & Limitation of Liability

The information contained anywhere within bereapca.org is provided on an “AS-IS” basis and BEREA assumes no responsibility regarding the information or other content and services provided on bereapca.org. This disclaimer of liability applies to any damages or injury – whether direct or indirect – caused by any failure of performance, error, omission, interruption, deletion, defect, delay, computer virus, theft, destruction, timeliness, or availability, except as limited by the Constitution of BEREA, the Book of Church Order of the Presbyterian Church in America, and applicable local, state, national, and international laws.

Privacy

BEREA does not generally collect personally identifiable information while YOU are using the public areas of the website. BEREA may log IP addresses for purposes of improving the web site operation. BEREA may also make use of “cookies” to monitor aggregate statistics regarding the general use of this site (including but not limited to statistics such as the number of daily users, peak usage times, type of browser used, etc…).

Email sent by YOU to BEREA (including but not limited to its officers, staff, and members) will be handled by BEREA as carefully as practicality, custom, and the law permit. However, due to the highly non-confidential nature of email and the world wide web, sensitive information should NOT be sent by YOU to BEREA (including but not limited to its officers, staff, and members) via email. Such correspondence is inherently at risk for misdirection or interception (both intentionally and inadvertently) and is advised against by BEREA.

Restricted or controlled access areas may be available on bereapca.org for members only. Personally identifiable information is required by BEREA of those who apply for access. In that event, BEREA will not knowingly share with any non-member parties the personally identifiable information. Additionally, the content of the restricted or controlled area will not knowingly be shared with any non-member parties.

At all times, personally identifiable information pertaining to YOU and BEREA’s members (who do or do not use bereapca.org) will be protected from third parties using reasonable means. BEREA is not responsible, however, for any accidental or illegal loss or disclosure of personally identifiable information to the public. By providing any personally identifiable information to BEREA, YOU agree that the risk of injury from the foregoing rests entirely with YOU.

The services provided through bereapca.org are available for your own personal use subject to the TOU here. Copying or downloading any material for personal and non-commercial purposes IS permitted. YOU may NOT otherwise redistribute, reproduce, or exploit the content provided by BEREA on bereapca.org without the express written permission of BEREA.

Duration of Service

BEREA reserves the right at any time to alter, discontinue, suspend, or terminate any or all of the service described herein with or without notice. BEREA will not be liable to YOU or third parties for any change in the availability of its service.

Links to Other Sites

BEREA may make available links to other World Wide Web sites and locations. Although BEREA will attempt to provide links only to reputable and reliable places, YOU acknowledge and agree that BEREA is NOT responsible or liable for the availability, content, advertising, products, or other materials on or available from external sites and locations. YOU agree that the links are provided for your own amusement and BEREA does not expressly endorse any of the sites linkable from bereapca.org.

Indemnification

YOU agree to defend, indemnify, and hold harmless BEREA, its officers, staff, employees, and members from and against any and all claims and expenses, including attorney’s fees, arising out of the use of bereapca.org by YOU or by access account(s) granted to YOU.

Miscellaneous

These TOU supersede all prior written and oral agreements between YOU and BEREA, which relate to the general use of bereapca.org. Additional agreements and terms may be required of those with controlled access or editing/design capabilities. These TOU shall be construed according to the laws of the State of Delaware.
